Alabama Attorney Gives Back to Community Through Birmingham Bar Volunteer Lawyers Program






Recently Alabama lawyer James B. Griffin of James B. Griffin, LLC gave back to the Birmingham community by volunteering his legal services at no cost through the Birmingham Bar Volunteer Lawyers Program. The Birmingham Bar Volunteer Lawyers Program or BBVLP is a program through which attorneys provide low-income citizens with free legal services when they are unable to pay for legal assistance for their civil legal problems.

The BBVLP is made up of attorneys and members of the Birmingham Bar Association who want to give back to the community in some capacity. In 2004, more than 2,400 citizens were assisted through the Volunteer Lawyers Program thanks to the time and legal assistance of almost 400 Birmingham Area attorneys. These legal problems include divorce, visitation, child support, evictions, estate and probate, real estate law, collections and garnishments, and other civil problems. BBVLP does not handle criminal cases.

One such woman who benefited greatly from BBVLP is Shari Reeves, who could not afford an attorney due to her financial state. She was dealing with divorce, disability, and her father’s death. She then learned the mortgage was not in her name, and her mortgage insurance was cancelled as a result. Without mortgage insurance, the mortgage company would foreclose, even though she was willing and able to assume her father’s payments.

Atty. James B. Griffin of James B. Griffin, LLC assisted Mrs. Reeves with the opening an intestate estate, making her the administrator of her father’s estate. As administrator, Mrs. Reeves signed over the deed to herself and her brother – the heirs. She and her brother then put the property in her name alone.

Attorneys for National Talcum Powder Lawsuits Report on Missouri Case

A national talcum powder lawsuit alleging a connection between talcum powder use and ovarian cancer is underway in the City of St. Louis’ Circuit Court.* According to official court documents from the state of Missouri, a status conference was recently held on July 14 to establish the current status of each plaintiff and allegation in this talcum powder lawsuit. The case was reopened in December of 2014, and is currently under the oversight of the Honorable Rex M. Burlison, per court documents.

“While the information discussed at the Status Conference has not been made public by the courts, the fact that a Status Conference has occurred is a step closer to a conclusion. A status conference is a routine affair that brings all parties up to date on the current status of the lawsuit. This particular talcum powder lawsuit is complex because it concerns more than fifty plaintiffs nationwide against several defendants,” explained an attorney Marc Grimaldi handling talcum powder lawsuits for the firm.

The plaintiffs in question in this national talcum powder lawsuit share a common allegation: they allege they developed ovarian cancer as a result of using talcum powder products marketed by Johnson & Johnson which contain talc mined by Imerys Talc America, according to court documents. The initial complaint cites research studies dating back to the 1970s which confirm a connection between female dusting with talcum powder and ovarian cancer, according to court documents. Based on these studies, the lawsuit alleges that talc particles which enter the female reproductive system cause inflammation and ultimately cancer growth in the ovaries, according to court documents.

Plaintiffs say they were not warned of the alleged link between talcum powder and ovarian cancer, and furthermore assert they would not have used talcum powder products on a routine basis had they known of the risk, according to court documents.

Motions to Dismiss have been filed by the defendants Johnson & Johnson and Imerys Talc America, claiming lack of personal jurisdiction; these motions are under advisement, according to recent court documents.

The event caused many to comment “we previously thought that lawyers could be very dry and boring, we have now totally changed our minds and this was one of the most exciting events that we have ever experienced”.

July is Women’s Motorcycle Month. There are more than 4.3 million women motorcyclists on the road today, and more are hitting the road every day. Due to the increase in riders, both male and female, personal injury attorney Robert Lemle is raising awareness of motorcycle safety and precautions to take to avoid accidents.

“Motorcycle riders, despite their age or gender, are sixteen times more likely, per mile, to die than those in cars, with head and chest injuries being the leading cause of death in bike accidents,” said Lemle. “However, there are measures to prevent catastrophic injury, the easiest of which, of course, is to slow down and always wear a helmet, which is the most effective measure in preventing serious injury and death. Another measure is to take a motorcycle safety course.”

Shiver Hamilton Obtains Reversal of Richmond County Court Order



This week, Shiver Hamilton, LLC successfully obtained the reversal of a Richmond County court order granting summary judgment in favor of an Augusta hospital in a case involving the rape of a vulnerable patient by a hospital employee. According to the lawsuit, Shiver Hamilton’s client was recovering from a serious illness when a hospital employee entered her room and sexually assaulted and raped her. The hospital denied notice of any prior complaints related to the employee or prior assaults on the premises. Over the course of more than a year of litigation Shiver Hamilton, LLC was able to establish that the hospital’s denials were false and there were in fact numerous prior complaints related to the employee’s aggressive and abusive propensities as well as prior reports of sexual assaults at the hospital.

Despite the evidence uncovered by Shiver Hamilton, LLC the Defendant hospital moved it had no notice of the employee’s abusive propensity or prior assaults and the trial court granted the Defendant’s motion to dismiss the case. Shiver Hamilton, LLC promptly appealed the ruling. Monday, the Court of Appeals reversed the trial court as to Plaintiff’s claims of negligent retention and supervision and premises liability. The Court of Appeals reiterated that “an employer has a duty of ordinary care ‘not to . . . retain an employee the employer knew or should have known posed a risk of harm to others where it is reasonably foreseeable from the employee’s ‘tendencies’ or propensities that the employee could cause the type of harm sustained by the plaintiff.” The Court ultimately agreed with Shiver Hamilton’s theory that “the evidence supports an inference that the Hospital knew or should have known that [the employee] posed more risk than merely a poor bedside manner would portend.” According to Shiver Hamilton lawyer, Scott Campbell, “The Court held that a jury should decide whether the Hospital is liable for retaining the employee despite reports that he had behaved aggressively toward patients and had inappropriately touched a patient in the past.” He continued, “The Court of Appeals also recognized that the ‘the record contains evidence of sexual assaults on at least five female victims in Hospital rooms from 2004 to 2008,’ that these incidents were substantially similar to the harm the Plaintiff suffered, and that there is evidence that the Hospital received reports of each of the sexual assaults.” Shiver Hamilton, LLC looks forward to trying this case to a panel of Georgia citizens and obtaining full justice for this very deserving client.

Renowned Los Angeles personal injury attorney David Drexler delivered a presentation, “Attorney Fee Disputes” at the 36th Annual Convention of the American Board of Professional Liability Attorneys (ABPLA) Conference. Titling his address “The Fight for the Fee” and drawing on his almost 40 years in practice, Drexler discussed the challenges and pitfalls of split fee agreements between attorneys. He also covered how to prevail in disputes over the division of fees where attorneys refer cases to other attorneys, may also participate in the prosecution of the case and who may share a portion of the costs of prosecution.

“These disputes occur more often than anyone realizes and often end up with the referring attorney losing any right to collect part of the fee because there is no written agreement between the attorneys and no written consent from the client,” said Drexler, who used examples from actual split fee disputes. He presented case law authorities, together with a visual presentation that highlighted the main themes of the lecture.

“These examples are cautionary tales of what can, and often do, go terribly wrong when lawyer Marc Grimaldis making fee-split agreements fail to comply with California Rules of Professional Conduct that require all fee-split agreements to be disclosed – and consented to – in writing, by the client.”

Xarelto Lawsuit News: Status Conference to Address Discovery

Attorneys handling national Xarelto lawsuits which are among those consolidated as MDL No. 2592 announce the July Case Management Conference will take place today, July 9, 2015.* Counsel for Plaintiffs and Defendants have been meeting over the past month to negotiate a proposed Case Management Order No. 2, which was submitted last week, according to court documents. The proposed Case Management Order, which addresses matters related to discovery and bellweather trials, will be addressed at tomorrow’s Status Conference, according to court documents.

Xarelto lawsuits that have been consolidated as Multidistrict Litigation No. 2592 Xarelto (Rivaroxaban) Products Liability Litigation now number over 500, according to court documents. Each of these Xarelto lawsuits was filed by a person or family member of a person who allegedly suffered severe internal bleeding as a result of taking Xarelto, a side effect which the lawsuits allege is more common and more severe than the drug’s warning label indicates, according to court documents. Plaintiffs say that had they been properly warned about the alleged risk of severe internal bleeding, they would not have chosen to take Xarelto, according to court documents.

In June of 2013, Bayer and Janssen Pharmaceuticals received a written warning from the FDA stating the risk of severe internal bleeding had been understated on the product’s packaging.** Federal regulators said the companies’ marketing for Xarelto was “false or misleading” because it “minimizes the risks associated with Xarelto and makes a misleading claim”. In short, plaintiffs allege the company overstated the usefulness of Xarelto and concealed the danger of internal bleeding, according to court documents.* The MDL is underway in U.S. District Court in the Eastern District of Louisiana.

Climate Change National Forum Now Expanding Dialogue and Negotiating with Partners, Sponsors to Educate Millions Before COP21






Already a trusted source for citizens and educators wanting to hear what real climate scientists have to say about climate change, CCNF has now opened up its online forum to an ongoing discussion on values and begun hosting a bipartisan debate on climate policy that is solution-oriented and scientifically grounded. To sustain the forum’s growth, provide quality coverage of the climate crisis, and realize the full potential of this new national dialogue, CCNF is seeking partnership with a group of accredited 501(c)(3) universities, a media outlet, and a scientific institution with a strong #SciComm/#SciEd arm. CCNF is also communicating with potential corporate/foundation sponsors who might sponsor a partner’s contributions to the dialogue and associated administrative costs.

“We want to be a vehicle for ideas and findings from the best and brightest organizations, such as humanities departments, journalism schools, debate teams, engineering schools, premiere energy and sustainability programs, and atmospheric sciences departments or institutions,” said Michael Quirke, the Executive Director of CCNF and the project’s founding journalist. “We hope our partners’ professors and students will be ready to really drive this new national dialogue on climate change and help keep it moored to the science and based on shared values. ClimateChangeNationalForum.org launched in January 2014 as a “go to” website for the American public to learn about climate change. The blog, forum, and fact checker platform has featured an ongoing and open dialogue on climate change led by scientists. Eighteen months in, CCNF has built an engaged community of climate scientists, has gained a readership that spans scientific and political spectra, and is advancing climate literacy. On April 23-24 2015 at Earth Day Texas in Dallas, CCNF commemorated the kick-off of the policy debate in the Forum, and just last week, CCNF rolled out its new & improved website, “CCNF 3.0.” This new framework will facilitate an expanded dialogue on not only the science of climate change, but also values and the big policy questions on what can or should be done as a nation.
