With many fraudulent and predatory timeshare operations in existence, it can be easy for consumers to fall prey to scams. Wesley Financial Group CEO Chuck McDowell recently shared his insights into the high-pressure sales tactics commonly used in timeshare presentations and how consumers can shut them down.

McDowell has considerable experience as a consumer advocate within the timeshare industry. For first time vacationers, timeshare representatives will often contact the individual shortly after check-in, claiming to have a welcome gift or asking him to complete a brief survey. Once the consumer attempts to claim the gift or complete the survey, salespeople will pressure him into purchasing a timeshare on the spot. One way timeshare salespeople do this is by telling consumers they only have a limited amount of time to act on the deal before they lose it forever.

First time users of timeshares aren’t the only ones subjected to dubious sales tactics, McDowell added. For example, existing timeshare owners are sometimes pressured into purchasing additional timeshare credits by telling them there is something wrong with their account and explaining the only way to remedy the issue is by purchasing additional credits from the resort.

Some tips for consumers to shut down these tactics:

●    Don’t agree to anything immediately

Never fall for the “it’s only good for today” scam. Consumers should never agree to purchase a timeshare on an impulse, no matter how much pressure the salespeople put on them. McDowell advises taking at least 24 hours to think the deal over before agreeing to anything. Consider how purchasing a timeshare will affect the family budget and talk it over with a trusted friend as well as the family accountant or lawyer Marc Grimaldi.

●    Buy on secondary markets, not directly from resorts

Despite what salespeople may say, timeshares are a depreciating asset. If a consumer does decide to purchase one, going through an online auction site is a much smarter alternative to purchasing directly from a resort. Order Governing Federal Xarelto Lawsuits Allows Electronic Filing of Plaintiff, Defense Fact Sheets




Hundreds of federally-filed Xarelto lawsuits (http://ift.tt/1yOGF8p) involving the drug’s alleged association with uncontrollable internal bleeding and other serious complications continue to move forward in the federal multidistrict litigation now underway in the U.S. District Court, Eastern District of Louisiana. According to a Pretrial Order dated June 23rd, all of the parties involved in the proceeding have agreed to accept online submission of Plaintiff and Defendant Fact Sheets via the online MDL Centrality System. (In Re: Xarelto Products Liability Litigation, No. 2592)

All of the plaintiffs involved in this litigation accuse the drug’s manufacturers of failing to provide adequate warnings regarding its risks, including the fact that their currently exists no approved antidote for reversing the internal bleeding sometimes associated with its use. They also allege that the manufacturers wrongly positioned Xarelto as an improvement over warfarin, a blood thinner that has been in use for decades. Among other things, the lawsuits point out that unlike Xarelto, internal bleeding associated with warfarin can be reversed with the administration of vitamin K.

According to court documents, Xarelto is a new-generation anticoagulant that was approved by the U.S. Food & Drug Administration in 2011, and is now indicated for the prevention of strokes in people with atrial fibrillation; the treatment of deep vein thrombosis and pulmonary embolism; and the prevention of deep vein thrombosis in patients undergoing hip or knee replacement surgery. The Xarelto label includes a black box warning that contains information about the increased risk of blood clot formation after premature discontinuation of the medication in the absence of adequate alternative anticoagulation.*

UHY LLP Potential Recruits Work with DPS Students to Sharpen Reading and Writing Skills



On Thursday, June 4, UHY LLP’s Michigan practice invited a group of students from Thirkell Elementary in Detroit to their Farmington Hills office to help them develop stories for the Beyond Basics Publishing Center. UHY teamed up with Beyond Basics, a local 501c(3) nonprofit organization working to improve literacy and raise reading proficiency in inner city schools, to host students to help improve reading comprehension and expand the students’ vocabularies.

Nearly 20 college recruits and other UHY employees gathered at UHY’s training facility to help students from Mrs. Jackson’s third grade class write their own personal stories. Each volunteer was assigned a student to mentor for the day. The recruits started by getting to know the students. With this information, the students created a short story that was designed to enhance vocabulary and sharpen writing skills. After the stories were written, each student was able to pick a book of their choice and read to their “buddy” or mentor.

As a result, 16 new stories were created for the Beyond Basics Publishing Center. This community event was part of UHY’s Connect program. The program allows college recruits to get to know more about the organization, work with UHY employees, and experience some of the corporate social responsibility initiatives UHY takes part in. Both the students and UHY recruits benefited greatly from the experience.

“We have been working with Beyond Basics for the past four years, pairing our interns and college recruits with students from Detroit Public Schools. The objective of this program is to not only help strengthen the reading and writing skills of elementary school students but to also give our interns and recruits an understanding of UHY’s commitment to giving back to the community and experiencing a volunteer outing first hand,” said Rina Henning, UHY LLP recruiting manager.

Casetext Announces LegalPad, a Technology to Transform the Way that the Legal Profession Writes about the Law

Today Casetext, an innovative, free legal resource announced the launch of a new writing tool, LegalPad. The technology is aimed at helping lawyers do something core to the profession: write about the law. The initial version of LegalPad is designed to help lawyers who write commentary about the law online. According to a survey by the American Bar Association, an estimated 10% of attorneys and 27% of law firms have legal blogs, which translates to tens of thousands of attorney bloggers. Blogging can have marked impact on enhancing practice reputation and building referral networks. In fact, 60% of solo practitioners and nearly 40% of law firms report that blogging has resulted in new clients or referrals.

Casetext has even developed technology to recognize what case an author is writing before they’ve even finished typing it. These are the types of features that make writing about the law orders of magnitude better than traditional tools.

While LegalPad is already a major improvement for people who publish legal analysis, it’s also just the first step in a long-term effort to transform the way people everywhere read, write, and collaborate about the law. National Xarelto Attorneys Announce Over 100 New Xarelto Lawsuits

Originally from Paterson, Marquis D. Jones, Jr. began his career in the United States Air Force, serving in the USAF from 1976 through 1987 and rising to the rank of Staff Sargent. Following his military service, Jones earned his J.D. from Rutgers Law School in 1994. He then worked in private practice for the next decade before being appointed Deputy Attorney General for the New Jersey Office of the Insurance Fraud Prosecutor (OIFP) in 2004.

The New Jersey Legislature installed Jones as a NJ Superior Court Judge for Ocean County in January 2008. Judge Jones was one of only two African Americans to serve on the Ocean County Superior Court bench at the time. During his tenure in Family Court, Jones presided over countless divorce, child custody matters, non-dissolution and juvenile cases. Judge Jones was also designated lead Children in Court Judge. In this role, he authored opinions in child abuse and neglect cases.

“Ensuring the health, safety, and welfare of children was and will remain a focus of mine, ” says Jones of his record.

Jones is pleased that his decision to enter private family law practice has provided him with the opportunity to work with Weinberger Law Group. Testosterone Lawsuit News: New Testosterone Case Transferred to MDL

Testosterone lawyers announce the transfer of a new testosterone lawsuit to U.S. District Court in Northern Illinois for pretrial consolidation as part of MDL 2545.* The case, which was transferred from a Nebraska court, is just the latest in a series of 200 testosterone lawsuit claims that have been transferred since the initial consolidation a year ago, according to court documents.**

The new case, Castro et al v. AbbVie Inc et al, is representative of a group of plaintiffs taking legal action against the marketers of testosterone replacement therapy products for men, according to court documents. Each of these cases shares common questions of fact with over 1750 testosterone actions currently pending in the Illinois District Court, according to court documents. Sharing common questions of fact means the lawsuits make the same allegations against a common group of defendants; in this case, plaintiffs allege the makers of testosterone replacement products glossed over the risks associated with the supplement and exaggerated the benefits, according to court documents. Furthermore, plaintiffs allege marketers engaged in aggressive, off-label marketing campaigns, encouraging men to self-diagnose a fictional disease called “Low-T”, according to the initial complaint court document.

Any testosterone lawsuit making these same allegations against one of more than a dozen defendants (all of whom are pharmaceutical companies selling one or more testosterone replacement therapy products), if filed by an American citizen, has been granted automatic transfer status to the MDL, according to court documents. MDL is a legal procedure used to simplify and expedite complex litigation involving hundreds of patients seeking damages for similar claims, according to court documents.

All the testosterone lawsuit cases that have been transferred to the MDL have been assigned to the Honorable Matthew F. Kennelly for pretrial procedures such as discovery, according to court documents.

8 Ways Women Can Social Media-Proof Their Divorce

These days, when something happens in our lives – large or small – we post about it online for our friends and family to see. As any divorce attorney will tell you, this can either help or hurt women getting a divorce.

“While many people know that social networks contribute to breakups, they don’t realize that they can also have unforeseen consequences in divorce settlement negotiations,” says Jeffrey A. Landers, a divorce financial advisor and author of Divorce: Think Financially, Not Emotionally® Volume II.

In fact, according to the American Academy of Matrimonial Lawyers, 81 percent of its members have used or encountered evidence taken from social media websites. Two-thirds of that material comes from Facebook.

Landers, founder of Bedrock Divorce Advisors, LLC, a divorce financial advisory firm that works exclusively with women throughout the United States, offers the following advice for leveraging social media while keeping it from becoming a liability in a divorce.

1. Understand that e-mail and text messages can be admissible evidence in court. Save everything you receive from your husband. Conversely, don’t write anything you wouldn’t want a judge to read.

2. If you think your husband is hiding assets, check his social media activity. Even if he has blocked you, it’s likely you have mutual connections who might tell you about updates related to expensive toys or a lavish lifestyle.

3. Check his friends’ social media updates for revealing information. Maybe his pals shared pictures of their trip to Vegas in his new BMW or his girlfriend tweeted about an expensive gift after he pleaded in court that he’s broke.

4. Watch for information online that conflicts with what your husband says in legal documents. Any discrepancies, such as living a lifestyle that he shouldn’t be able to afford, can be used to undermine his credibility in court.

5. Check dating sites. Don’t presume he’s smart enough to lay low. Compare what he says in his profile to what he’s saying about himself in court.

6. It works both ways, so be squeaky clean online. Exercise caution, discretion, and good judgment because he can use anything he finds about you in the same way you can use what you find about him.

7. If you can’t keep anything to yourself, deactivate your social media accounts until after the divorce. You know who you are. If you can’t keep a secret and might reveal information that could be used against you, protect yourself by avoiding all social media.

8. Proceed with caution. Not every “friend” is a friend, not every follower is a supporter, and not every connection is an ally. You might delete something you shouldn’t have posted, but someone else might have saved a screenshot of it.
